These Terms & Conditions ("Terms") govern your access to and use of ElectricBikes.com and all related subdomains, pages, content, newsletters, email communications, forms, and services (collectively, the "Site"), operated by ElectricBikes.com ("we," "us," or "our").

By accessing the Site, reading our content, subscribing to our newsletter, submitting any form, clicking an outbound link, or otherwise using the Site in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Site.

Any warranty for a product is provided solely by the manufacturer or seller of that product, not by us.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ELECTRICBIKES.COM, ITS OWNERS, EDITORS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE OR ANY CONTENT, PRODUCT, OR THIRD-PARTY SITE.

Without limiting the foregoing, we are not liable for any personal injury, death, property damage, fire, battery failure, crash, mechanical failure, financial loss, or any other harm of any kind arising from: (a) your reliance on any content; (b) your purchase, use, modification, charging, maintenance, or operation of any product referenced on the Site; (c) the acts or omissions of any manufacturer, dealer, retailer, advertiser, or other third party; or (d) any product recall, defect, or safety issue, whether or not described on the Site.

The absence of a safety note, recall reference, or warning on any page does not mean a product is safe or free of recalls. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Site shall not exceed one hundred U.S. dollars (US$100.00). Riding electric bikes, OneWheel boards, scooters, and other electric rideables is inherently dangerous and can result in serious injury or death. You assume all risk associated with the purchase, use, and operation of any such product. You are solely responsible for wearing appropriate protective gear, obeying all applicable laws, following manufacturer instructions, and riding within your ability.

You agree that we have no responsibility or liability for any decision you make or action you take based on content found on the Site.

The Site contains links to third-party websites, products, services, advertisers, and resources that we do not own or control, including manufacturer sites, dealer locators, retailers, and our legal-referral partner. When you click a link to leave the Site, you do so at your own risk and are subject to the terms and privacy policies of that third party.

We are not responsible for the content, accuracy, availability, products, services, pricing, security, or practices of any third-party site, and the inclusion of any link does not imply our endorsement.
